Liability for car insurance should be compulsory.
I went to my insurance company a few days ago, and they said that Liability is compulsory for everyone.
Liability does not cover you and your car in case of an accident. Only the other person's car.

Or, if you are going through a lawyer, the lawyers will communicate with each other.
If you don't have a police report, it's hard to say because you don't have any evidence.

If you have a lawyer, it will cost you money, but it is better to have the lawyers or the insurance company communicate with each other, based on the Police report.
I think everyone has to have Liability in California, and Liability only covers the other party's car and the other party only.
And if you don't have it, you have to pay for everything in an accident.

Or you can go to Small Claim Court and talk to the other party and the judge will decide. Unlike normal, this court deals with small items.

Thanks for writing. I wanted to reply, but it was like sending an email and I'm not sure how Vivinavi works, so I'll leave it here.
We did not have Liability, but had insurance on the rental car itself. The receptionist told me Liability was optional. That's not right either. This is a rental company with quite a lot of stores. We did not call Police. We had just come to the US and had an accident and were panicking.
The other driver was from Korea, but I don't know if he was in a hurry or what, but we didn't call them.
I have looked into credit card insurance and company insurance that would cover this accident, but I seem to be at a loss. We are still in the process of negotiating the amount.

In the U.S., you must call the police immediately after a traffic accident and get a police report. The first thing Americans do after an accident is to call the police. You have to do it. You should remember that.
If you don't get a police report, you will usually get into a dispute with the other party, and it will not work. If you call the police, the insurance company will take action, but if you don't get a police report, the insurance company will not take action because they don't want to pay you money. You will cry yourself to sleep.
Even now, it is better to go to Police and ask them to write a report and negotiate directly with the other party and have the insurance companies work with each other because it will never work.
